These Terms of Service ("Terms") govern the supply of products and services by Fortress Freedom Phone Ltd ("Fortress", "we", "us") to you ("the customer", "you"). By creating an account, buying credits or a subscription, placing an order, or using a Fortress service, you agree to these Terms together with our Acceptable Use Policy, Privacy Policy and Cancellation and Refund Policy. You must be legally able to enter this contract. If you are under 18, you may only use the service with the consent of a parent or guardian, and that person is responsible for your use of the service.

1. About us

Fortress Freedom Phone Ltd is a private limited company registered in England & Wales (Companies House No. 17168647). Official app help is available on our Support page. You can reach us at [email protected], on Telegram at @FREEDOM_PHONE, or by phone on 07822 016492.

2. The service we provide

We supply the following products and services:

Freedom Fone requires a working internet connection and depends on app stores, DIDWW and downstream telephone carriers. Number type, country, calling, messaging, shortcode and verification support vary. A number being offered in the app does not guarantee that every bank, platform or verification service will accept it.

Normal app signup does not require a government identity document, selfie or proof of address. We may restrict or withdraw number inventory where a carrier or applicable rule requires customer documents that the standard Freedom Fone flow does not collect. A country-presence confirmation may be required for certain offered numbers.

3. Pricing & payment

Current prices are set out on our home page and are inclusive of any VAT we are required to charge. We accept payment by Soclo Payments, cash (in person or by post), UK bank transfer, debit/credit card, and cryptocurrency. Pay securely with Soclo Payments (soclo.app) — contact us to arrange settlement. Payment is due in full at the time of order unless we have agreed alternative terms in writing.

Where an auto-renewing in-app subscription is offered through Apple or Google, fees are billed in advance under store terms. We reserve the right to vary website prices on 30 days' written notice for future purchases.

App credits may be purchased through Apple or Google or, where offered, by signing into your account on our website and paying by card or cryptocurrency. Credits do not expire, have no cash value, cannot be transferred between accounts, and are used for number rental, renewal and metered communications. A subscription may add credits at each successful renewal; it does not make carrier usage unlimited unless the product expressly says so. Current launch prices for a standard app number every 30 days are United Kingdom £8.99, United States £6.99, Canada £6.99, Netherlands £7.99 and Israel £8.99. The live quote shown before purchase controls. If your credit balance is insufficient at renewal, a number may be suspended and later released.

Calls currently use 15p of credit per started answered minute. SMS currently uses 15p of credit per segment; a long message or some characters may require more than one segment. The app deducts credit only when an answered call or send attempt reaches the service.

Keep Number: while offered, an eligible active number can be switched to a 12-month reservation from app credit. Current launch prices are United Kingdom £59.99, United States £49.99, Canada £49.99, Netherlands £59.99 and Israel £79.99; the live price shown before confirmation controls. The 12-month period begins after the number's already-paid period, then renews annually from credit at the price disclosed before renewal. We allow a 30-day non-payment grace period before release. Calls, messages, forwarding and other usage remain separately metered. Keep Number is a renewable service reservation, not ownership of the telephone number and not a lifetime guarantee. It remains subject to the account being in good standing, applicable law, acceptable use, and continued availability from our carrier. We will give reasonable notice of a price change where practicable and will not shorten a paid reservation period.

Cryptocurrency top-ups are credited only after our payment provider confirms the transaction. Blockchain transfers are generally irreversible. You are responsible for using the asset, network and exact amount specified by the checkout. Underpayments, unsupported assets or transfers to an incorrect address may be delayed or unrecoverable. Overpayments do not create an entitlement to credits beyond the pack selected, but you may contact support for review.

Apple or Google controls in-app purchase billing, tax, cancellation and refunds under the terms applicable to your store account. Auto-renewing subscriptions continue until cancelled in your app-store subscription settings. Our Cancellation and Refund Policy explains the correct route for store purchases, website top-ups, credits, number periods and Keep Number.

4. Order acceptance

An order is accepted when we confirm it to you in writing (by email or messaging). We reserve the right to refuse any order at our sole discretion, including but not limited to where we reasonably suspect the order falls outside the lawful uses set out in our Acceptable Use Policy. Where we refuse an order, any payment taken in respect of that order will be refunded in full within 14 days.

5. Delivery, collection & risk

Same-day dispatch is available on orders placed before 3pm UK time, Monday to Friday, subject to stock and any required customer screening. Standard delivery is by tracked, signed-for courier in plain packaging. Collection in central London is available by prior appointment.

Risk in the device passes to you on delivery (or, where collection is agreed, on handover). Title in the device passes to you on receipt of payment in full.

6. Your right to cancel (Consumer Contracts Regulations 2013)

If you are a consumer (i.e. acting outside your trade, business, craft or profession), you have a statutory right to cancel any contract entered into at a distance within 14 days of receiving the device, without giving any reason. To exercise this right, notify us by email at [email protected] within the 14-day period.

Where you cancel, you must return the device to us in re-saleable condition within 14 days of giving notice. Return shipping is at your expense. We will refund the price you paid for the device within 14 days of receiving it back, less any deduction for diminution in value caused by handling beyond what was necessary to inspect the device.

This statutory right does not apply to digital service periods (including number rental or Keep Number) that have already been provided to you at the time of cancellation, except where mandatory law requires otherwise.

For digital services begun during the cancellation period at your express request, you may be charged a proportionate amount for service already supplied. App-store purchases and refunds are also subject to Apple or Google's consumer and refund processes; this does not remove any mandatory consumer right.

7. Returns, faults & statutory rights

If a device develops a fault that is not the result of customer-caused damage, contact us as soon as you discover it. Under the Consumer Rights Act 2015, you are entitled to:

Nothing in these Terms limits or excludes your statutory rights as a consumer.

8. Acceptable use

Your use of any Fortress product or service is at all times subject to our Acceptable Use Policy. We may suspend or terminate a service for material breach. Consumed usage and irrecoverable carrier periods are not refundable unless mandatory law requires otherwise; any unused future service is handled under our Cancellation and Refund Policy.

9. Service availability

We aim to keep Freedom Fone and related services available continuously, but we do not warrant uninterrupted availability. From time to time, services may be unavailable due to scheduled maintenance, upstream-network incidents, or events outside our reasonable control. Where service is unavailable for an extended period for reasons within our control, we will at our discretion provide a pro-rata service credit on application.

Emergency calls: Freedom Fone does not support emergency calls in any country. Use your mobile carrier or another telephone and your local emergency number, such as 999, 112 or 911. The app and service block recognised emergency destinations and must not be your only means of contacting emergency services.

No verification guarantee: virtual and VoIP numbers may be rejected by banks, WhatsApp, social networks, government services, shortcodes or other third parties. Number reputation can also change because carriers recycle and reclassify numbers. Keep Number prevents routine expiry while the reservation remains active; it does not make any third party accept the number. This is not a defect where ordinary supported calling and messaging continue to work.

10. Liability

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any matter for which it would be unlawful for us to limit liability; or your statutory rights as a consumer.

Subject to the paragraph above, our total liability to you in connection with any contract for the supply of products or services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the price you paid for the device or, for recurring or prepaid digital services, the fees paid by you in the twelve months preceding the event giving rise to the claim.

We are not liable for any indirect or consequential loss, loss of profit, loss of business, loss of anticipated savings, or loss of data.

11. Termination

You may cancel an app subscription through Apple or Google and may release individual numbers in the app. Cancellation stops future subscription renewal but does not automatically release numbers while sufficient credits remain. We may suspend or terminate service for material breach, fraud, spam, unlawful traffic, non-payment, unacceptable risk imposed by a carrier, loss of upstream service, or where required by law.

Deleting a Fortress account does not cancel an Apple or Google subscription. Follow the account deletion instructions and cancel any store subscription separately to prevent renewal.

Released telephone numbers may be returned to the carrier and reassigned to another person. This includes numbers released after the disclosed grace period ends. Remove the number from important accounts before releasing it. We cannot guarantee recovery after release. The customer's hardened handset, if purchased outright, remains the property of the customer.

12. Changes to these Terms

We may update these Terms from time to time. The current version is identified at the top of this page. Material changes will be brought to the attention of active customers by email at the address held on file. Continued use of the service after a material change constitutes acceptance of the updated Terms.

13. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England & Wales. The courts of England & Wales have jurisdiction. If you are a consumer elsewhere, this choice does not remove mandatory consumer protections or any right to bring proceedings in a court that your local law requires us to recognise.
